Travel ban: What Buhari should have done – Clarke

A Senior Advocate of Nigeria, Chief Robert Clarke SAN, has faulted the travel ban slammed on 50 high-profile Nigerians by the administration of President Muhammadu Buhari.

The senior lawyer pointed out that the government failed to follow the due process of law in restricting people’s movement.

Speaking on Channel TV, Clarke said, “The constitution said every Nigerian shall have right to free movement.

“Therefore if anybody wants to restrict a Nigerian movement for one reason or the other, the person must go to court and ask, ‘please I have this dossier against this person he is facing a trial’ then he gets an order of exparte from the court and the exparte order is an interim order which allows the order when they are served the order to go to court and change the order.

“Many of them as rightly said I believe that their passports have been taken down after being granted bail.

“Whether their passports they want it or not any time the government want to implement Order 6 it better for the Attorney-General will make a list, go to court and get an interim order. That is due process.”
